1. Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Pinnaya mobile application, website, and related services (collectively, the "Service"). The Service is operated by Moon Art Innovations Private Limited ("Pinnaya", "we", "us", "our").

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1.1 Eligibility

  • You must be at least 18 years old to use Pinnaya. We do not permit minors to use the Service.
  • You must provide accurate and complete information and keep it up to date.
  • You must not be prohibited from using the Service under applicable law.
  • You must use only one account unless we approve otherwise in writing.

1.2 Account, Verification, and Safety Checks

Pinnaya is designed for intentional, long-term relationships. To help keep the community safe and authentic, we may require one or more verification steps (for example, selfie verification, government ID verification, education or workplace verification, or email and phone verification).

  • If you choose to complete verification, you authorise us and our verification partners to process the information you submit to confirm authenticity and reduce fraud.
  • We may reject verification submissions that appear altered, inconsistent, or fraudulent.
  • If we believe an account is unsafe or inauthentic, we may restrict, suspend, or terminate it (see Section 1.8).

1.3 Progressive Profile Disclosure and Airlock Chat

Pinnaya may offer product features that reduce risk during early interactions, including progressive profile disclosure (where certain profile details are revealed progressively) and a protected initial chat layer ("Airlock Chat").

  • The exact details revealed and the timing can depend on your settings, mutual actions, and safety signals.
  • To prevent fraud and abuse, we may use automated systems, and in limited cases human review, to detect spam, scams, harassment, non-consensual sexual content, and other policy violations in profiles and messages.
  • Do not share highly sensitive information (such as passwords, one-time passwords, or financial details) in chat.

1.4 Community Rules (Objectionable Content Policy)

You agree not to post, share, transmit, or solicit content or behaviour that is illegal, harmful, or objectionable. This includes, without limitation:

  • Harassment, hate, bullying, threats, stalking, doxxing, or encouraging violence.
  • Non-consensual sexual content, sexually explicit content shared without consent, deepfakes, or nudity that violates the law or our rules.
  • Child sexual abuse material, grooming, or any content that exploits or endangers children (zero tolerance).
  • Impersonation, fraud, scams, or misleading claims about your identity, age, marital status, or intent.
  • Soliciting money, gifts, financial support, escort services, compensated dating arrangements, or any sexual act in exchange for compensation.
  • Pornography, sexually gratifying services, or content whose primary purpose is sexual gratification.
  • Illegal activities or content that violates any applicable law.

We may use filters, review systems, and enforcement actions to keep the platform safe. You can report content or users within the app. You can also block other users. We aim to review valid reports in a timely manner and take appropriate action, including removing content and restricting accounts.

1.5 User Content

You retain ownership of the content you submit to Pinnaya (such as photos, profile text, and messages) to the extent you have the rights to it.

By submitting content, you grant Pinnaya a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, reproduce, modify (for example, resize or format), display, and distribute your content solely for operating, improving, and providing the Service, including showing your profile to other users under your disclosure settings.

You represent and warrant that you have all necessary rights to the content you provide and that it does not violate any law or third-party rights.

1.6 Reporting, Blocking, and Moderation

Pinnaya provides in-app tools to report users and content, and to block users. We also maintain mechanisms to receive complaints and take action on objectionable content.

  • Reporting: You can report a profile, message, or other content from within the app.
  • Blocking: You can block users to prevent further interaction.
  • Moderation: We use a combination of automated and human review to identify and address violations.

If you believe content is illegal or presents imminent harm, you should also contact local law enforcement. Pinnaya is not an emergency service.

1.7 Coaching, Counseling, and Third-Party Services

Pinnaya may offer access to relationship coaching, workshops, or counseling sessions, which may be provided by third parties. These services are informational and support-oriented and are not medical care.

  • If you are experiencing a mental health emergency or risk of self-harm, contact local emergency services immediately.
  • Third-party providers may have their own terms, privacy practices, and professional obligations. Where applicable, we will share only the information needed to deliver the service.

1.8 Suspension, Termination, and Appeals

We may remove content, restrict features, suspend, or terminate your account if we believe you violated these Terms, our policies, or applicable law, or if your account poses safety risks.

  • We may take action without prior notice where required for safety, legal compliance, or platform integrity.
  • You may appeal certain enforcement actions by contacting our support channel listed in Section 3.
  • We may retain limited information after account termination where permitted or required by law, including for fraud prevention and compliance (see Privacy Policy).

1.9 Subscriptions, Billing, and Purchases

Some features may require payment. Purchases on iOS are typically processed by Apple. Purchases on Android are typically processed by Google. Web purchases, if offered, may be processed by third-party payment providers.

  • Auto-renewal: Subscriptions may renew automatically unless cancelled through the platform where you subscribed.
  • No guarantees: Paid features do not guarantee matches, dates, or relationship outcomes.
  • Refunds: Refund eligibility depends on the store or payment provider policies and applicable law.

1.10 Disclaimers

The Service is provided on an "as is" and "as available" basis, to the fullest extent permitted by law. We do not guarantee continuous availability, error-free operation, or specific outcomes.

You are responsible for your interactions with other users, including meetings offline. Use caution and follow safety best practices.

1.11 Limitation of Liability

To the fullest extent permitted by law, Pinnaya and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses arising from your use of the Service.

To the fullest extent permitted by law, Pinnaya's total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to Pinnaya for the Service in the 12 months before the event giving rise to the claim.

1.12 Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold harmless Pinnaya and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Service, your content, or your violation of these Terms.

1.13 Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, courts in Mumbai, Maharashtra will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.

1.14 Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use of the Service after the effective date of an updated version means you accept the updated Terms.

2.1 Privacy Summary

We collect: Information you provide (profile, preferences, verification submissions, and support requests), and information generated by your use of the Service (matches, messages, usage signals).

We use it: To operate the Service, match you with compatible people, keep the community safe, and improve the product. We do not sell your personal data.

Third-party advertising: We do not permit third parties to use your personal data for targeted advertising on Pinnaya without your consent.

Your control: You control what you share with other users, including through Progressive Profile Disclosure settings where available.

Your rights: You can access, correct, and delete your data and account (subject to limited legal retention requirements).

2. Privacy Policy

This Privacy Policy explains how Pinnaya collects, uses, shares, and retains personal data when you use the Service. It also explains your choices and rights under applicable Indian law, including the Digital Personal Data Protection Act, 2023 ("DPDP Act").

2.2 Personal Data We Collect

We collect the following categories of information:

2.2.1 Information you provide

  • Account and profile information: name, date of birth or age, gender, photos, bio, preferences, education and work (if provided), and contact information such as phone number and email address.
  • Identity and safety verification information: selfies, ID documents or ID-derived attributes, and verification status signals (if you choose or are required to verify).
  • Communications: messages you send through the Service, and communications with our support or safety teams.
  • Payments: purchase history and subscription status. Payment card details are processed by app stores or payment providers, not stored by Pinnaya in full.

2.2.2 Information collected automatically

  • Usage data: app interactions such as likes, matches, messages sent, features used, clicks, and timestamps.
  • Device and log data: device identifiers, IP address, device model, operating system, app version, and crash logs.
  • Location data: approximate location derived from IP address or device settings, and precise location if you enable it (for example, to improve matching by proximity).

2.2.3 Information from third parties (if you use them)

  • Verification providers: verification results and limited attributes needed to confirm authenticity and age (for example, verified status, and whether documents appear valid).
  • App stores and payment providers: subscription status and transaction identifiers.
  • Analytics and security providers: signals used to prevent fraud, abuse, and spam.

2.3 How We Use Personal Data

We use personal data for the following purposes:

  • Provide and operate the Service, including account creation, matchmaking, messaging, and profile display under your disclosure settings.
  • Verify authenticity and reduce fraud, including detecting duplicate or banned accounts and enforcing one-account rules.
  • Safety, trust, and compliance, including detecting and addressing scams, harassment, non-consensual sexual content, and other violations.
  • Personalisation and improvement, including refining recommendations, improving features, and fixing bugs.
  • Customer support and communications, including responding to requests and sending important notices about the Service.
  • Legal compliance, including responding to lawful requests and meeting obligations under applicable law.

2.4 Legal Basis and Consent (India)

Where required, we rely on your consent or other lawful grounds under applicable Indian law to process personal data. You can withdraw consent for optional processing at any time within the app settings or by contacting us. If you withdraw consent for data that is necessary to provide the Service (for example, basic account information), we may not be able to continue providing the Service to you.

2.5 How We Share Personal Data

We share personal data only as described below:

2.5.1 With other users

Other users can see the information you choose to share through your profile and interactions. If Progressive Profile Disclosure is enabled, some details may be revealed gradually based on mutual actions and trust signals.

2.5.2 With service providers

We use service providers for hosting, analytics, customer support tools, verification, fraud prevention, and communications. They may process personal data on our behalf under contractual obligations to protect it and use it only for providing services to us.

2.5.3 For safety and legal reasons

We may disclose information if we believe it is reasonably necessary to comply with law, enforce our Terms, protect the rights and safety of users, or prevent fraud or security issues.

2.5.4 Business transfers

If Pinnaya is involved in a merger, acquisition, restructuring, or sale of assets, your information may be transferred as part of that transaction, subject to appropriate safeguards and notice where required.

2.6 Message and Content Processing for Safety

Pinnaya may process profile content and messages to keep the community safe. This may include automated scanning for spam, scams, harassment, and non-consensual sexual content, and limited human review when needed to investigate reports, prevent harm, or comply with law. We do not sell message content, and we do not allow third parties to use message content for advertising.

2.7 Data Retention

We retain personal data for as long as necessary to provide the Service and for legitimate safety and compliance purposes. Retention depends on the type of data and the reason we collected it.

  • Account and profile data: retained while your account is active.
  • Messages and interactions: retained while your account is active, subject to deletion features and safety or legal retention needs.
  • Verification submissions: where feasible, verification documents and selfies are deleted after verification or within a short period, unless needed for fraud prevention, dispute resolution, or legal compliance.
  • Safety logs and enforcement records: retained for as long as needed to prevent abuse and comply with legal requirements.
  • Legal retention: certain records may be retained after account cancellation or content removal for at least 180 days, and longer if required by law or lawful orders (for example, for investigations, fraud prevention, or compliance obligations).
  • Deleted accounts: we aim to delete or de-identify personal data without undue delay after you request account deletion, except where retention is required or permitted by law.

2.8 Account and Data Deletion

You can initiate account deletion from within the app. Account deletion is intended to remove your account and associated personal data from our active systems, subject to the retention exceptions described above.

If you have shared content with other users (such as messages), copies may remain on their devices or in their chat history, but your account will be shown as deleted where applicable. Where feasible, we will remove or de-identify your user-generated content in line with platform requirements and applicable law.

2.9 Your Rights and Choices

Subject to applicable law, you may have the right to:

  • Access: request information about the personal data we hold about you.
  • Correction: correct inaccurate personal data.
  • Erasure: request deletion of your personal data and account, subject to legal retention requirements.
  • Grievance redressal: raise a complaint with us regarding our handling of your personal data before approaching relevant authorities.
  • Nomination: nominate an individual to exercise rights on your behalf in the event of death or incapacity (where applicable).
  • Opt-outs: opt out of certain communications and optional analytics where provided.

To exercise your rights, use in-app controls or contact us as described in Section 3.

2.10 Security

We use reasonable security safeguards designed to protect personal data, including encryption in transit, access controls, and monitoring. No system is completely secure, so you should protect your account credentials and report suspicious activity.

2.11 International Transfers

We may process and store personal data on servers in India and other jurisdictions where we or our service providers operate. Where required, we use contractual and technical safeguards to protect data transferred across borders.

2.12 Children and Age Restrictions

Pinnaya is intended for adults (18+). We do not knowingly collect personal data from minors. If we learn that a user is under 18, we will take steps to terminate the account and delete data subject to legal requirements.

2.13 Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means, and update the effective date.

We aim to acknowledge complaints within 24 hours and resolve them within 15 days of receipt. For certain complaints involving impersonation, nudity, or sexual content that appears to expose private areas, we aim to remove or disable access to such content as quickly as possible and, where applicable, within 24 hours of receiving a complete complaint. For other categories of unlawful content reported under applicable rules, we aim to resolve reports within 72 hours where applicable.

We may request additional information to verify your identity or to locate the relevant content before taking action.
